1. About This Agreement

This document sets out the terms under which skateboarding lessons and related activities (“Sessions”) are provided by Dobtown Skateboarding Sydney & ABN] (“we”, “us”, “our”).

By signing below, you agree to these terms for yourself and/or for the child named in this form.

If the Participant is under 18 years of age, a parent or legal guardian must complete and accept this agreement.

2. Nature of Skateboarding Activities

Skateboarding is a physical, action-based activity that involves balance, speed, obstacles, surfaces, equipment, and other participants.

Despite safety measures, coaching, and supervision, skateboarding carries inherent and unavoidable risks, including the possibility of serious injury, permanent disability, property damage, or death.

By choosing to participate, you acknowledge that these risks cannot be eliminated.

3. Voluntary Participation & Acceptance of Risk

Participation in all Sessions is entirely voluntary.

By signing this agreement, you confirm that:

1) You understand the nature of the Sessions

2) You accept full responsibility for any risks associated with participation

3) You (or the Participant) take part at your own risk

This acknowledgement is intended to operate as a risk warning under the Civil Liability Act 2002 (NSW) and any applicable legislation.

4. Health & Capability Declaration

You confirm that the Participant:

1) Is physically and medically fit to take part

2) Has no condition, injury, or limitation that would make participation unsafe

3) Will notify us immediately if their condition changes

We rely on this declaration when allowing participation.

5. Safety Rules & Protective Equipment

All Participants must:

1) Follow instructions given by coaches at all times

2) Behave in a safe and respectful manner

3) Wear required protective equipment, including helmets, for the full duration of the Session

Failure to follow safety instructions may result in removal from the Session without refund.

6. Release of Liability

To the fullest extent permitted by law, you agree that Dobtown Skateboarding Sydney, its coaches, employees, contractors, volunteers, venue operators, and associated parties will not be liable for any injury, loss, damage, cost, or expense arising from participation in the Sessions, including where caused by negligence.

You waive any right to make a claim relating to:

1) Personal injury or death

2) Loss or damage to personal property

3) Any physical, psychological, or economic loss connected to participation

7. Indemnity

You agree to indemnify and hold harmless all released parties from any claims, demands, or legal proceedings brought by or on behalf of the Participant, including by third parties, arising out of participation in the Sessions.

8. Consumer Law Notice

Under the Australian Consumer Law, providers of recreational services may request that certain statutory guarantees do not apply.

By agreeing to this waiver, you acknowledge that, to the extent permitted by law, guarantees relating to due care and skill are excluded for recreational activities.

9. Insurance

Session fees do not include personal accident or medical insurance.

You are responsible for arranging your own insurance coverage for injury, illness, or loss.

10. Photography & Video

During Sessions, photos or videos may be taken for coaching, promotional, or marketing purposes.

By signing this agreement, you:

1) Consent to the recording of the Participant

2) Allow us to use this material across websites, social media, and marketing

3) Grant us ownership of the recorded content

4) Waive any right to payment, approval, or future claims relating to its use

11. Entire Agreement

This document represents the entire agreement between the parties and replaces any previous discussions or understandings.

If any part of this agreement is found unenforceable, the remaining sections will continue to apply.

12. Governing Law

This agreement is governed by the laws of New South Wales, Australia, and any disputes will be handled exclusively in NSW courts.

13. Acknowledgement & Acceptance

You are authorised to sign on behalf of the Participant (if applicable)
